Objectives: - Lead and manage CAPEX service contract activities for the assigned capital investment project(s) in China. - Well control the procurement plans of the CAPEX service contracts and ensure the proper implementation of procurement strategies and procedures. - Monitor and ensure the CAPEX service contracts executed on time and within budget. - Deliver the most competitive advantages to BASF throughout the lifecycle of the CAPEX service contracts. Claims management Main Task: - Act as central point-of-contact for all commercial and contractual activities related to the CAPEX service contracts and take the ownership. Taking project goals into account, develop and implement competitively advantageous the CAPEX service contracting strategies to enable the best execution for the project(s). 2. Support new service project contractor development and contractor relationship management to ensure alignment with project strategies. 3. Lead the tendering process following the defined strategies and procurement procedure and select competitive bids with compliance. 4. Conceptualize and develop the project serivce contracts based on aligned strategies and the project needs and expectations. 5. Develop and execute negotiation strategies that minimize potential losses and maximize BASF’s benefits. Lead the negotiations. 6. oordinate and obtain necessary approvals on the CAPEX service contracts and SAP POs following the defined approval matrix. 7. Ensure the proper implementation and handling of the commercial contract elements. 8. Identify commercial and legal risks and problems and solve and mitigate such proactively in close cooperation with the project manager and other team members. 9. Supervise the CAPEX service contracts execution adhering to schedule, budget, EHS, quality requirements and corporate compliance regulations as well. 10. Manage change orders, claims and back charges, and capture lessons learned; 11. Work collaboratively, efficiently and effectively with internal clients, including Business Unit, Legal, Finance, Tax, Audit, etc., and external parties including the CAPEX service contractors and competitors. Ensure timely contract close-out, amendment, or extension. 12. Organize the project team to review and evaluate the the CAPEX service contractor’s performances over the project execution. 13. Manage documentation, collate and organize all the CAPEX service bids and contracts centrally for the project including entry into the global contracts database. Requirements: 1. Education: Bachelor's degree in business and economics, administration, law or engineering; Master's degree is a plus 2. Working Experience: Minimum 8 years of CAPEX contract administration experience. 3. Technical & Professional Knowledge: Good knowledge of Contract Law and Construction Law is required; legal background is preferred. Knowledge on purchasing processes and guidelines is required. 4. Knowledge on cost structure is required; knowledge on cost engineering is a plus. 5. Good skill in both English and Chinese. 6. The person must be of integrity and strong ownership. null
