Position Summary
The Pre-Litigation Demand Writer is responsible for preparing high-quality, strategic demand packages that maximize settlement value for personal injury clients. This role combines legal writing, medical record analysis, case strategy, and negotiation support to produce compelling demands that position cases for optimal recovery. The Demand Writer works closely with attorneys, case managers, and negotiators to identify opportunities to increase settlement offers and achieve policy-limit resolutions whenever supported by the facts of the case.
Key Responsibilities
• Review medical records, bills, accident reports, and supporting documentation to evaluate damages and liability.
• Draft persuasive, well-supported demand letters that clearly present liability, injuries, treatment, and damages.
• Develop case-specific settlement strategies designed to maximize compensation.
• Identify opportunities to strengthen cases before or after an initial insurance offer, including recommendations for additional medical treatment, supporting documentation, expert opinions, or legal arguments.
• Collaborate with attorneys and negotiators to revise demand strategies based on insurer responses.
• Ensure all demand packages are accurate, complete, and submitted within established deadlines.
• Maintain organized documentation and case notes within the case management system.
• Stay current on insurance practices, negotiation strategies, and personal injury case law relevant to pre-litigation matters.
Qualifications
• Experience drafting personal injury demand letters in a pre-litigation environment.
• Strong legal writing and persuasive communication skills.
• Ability to analyze medical records, billing records, and insurance policies.
• Knowledge of personal injury claims handling and insurance negotiation practices.
• Strong analytical and critical-thinking skills.
• Excellent attention to detail and organizational abilities.
• Ability to manage multiple deadlines in a fast-paced environment.
